1. Personal data

Hladky IT Consulting GmbH, Spalowskygasse 2/6, 1060 Vienna, Austria, collects, processes, and uses personal data where it has the consent and/or registration for the relevant purpose, as agreed with you as the user, or where there is some other legal basis under GDPR; furthermore, collection, processing, and use are subject to the proviso of compliance with data protection legislation and provisions under civil law.

Hladky IT Consulting GmbH only collects personal data that are required in order to carry out and perform its services or personal data which you have voluntarily provided.

Personal data are all data containing details of personal or material circumstances, such as a person’s name, postal address, email address, phone number, date of birth, age, or gender, as well as video recordings, photos, voice recordings and also biometric data such as fingerprints. Personal data may also include sensitive data, such as details of a person's health.

2. Access to and erasure of data

As the user, you may at any time access your personal data stored within our system and obtain information about their origin, recipients, and the purpose of data processing; furthermore, you have a right to rectification, data transfer, objection to and restriction of data processing as well as to the blocking or erasure of incorrect or unlawfully processed data.

You may at any time revoke any consent you have given for the use of your personal data unless such use is mandatorily required for the fulfillment of contractual duties. If you wish to access, erase, rectify, object to and/or transfer data, please write to the Hladky IT Consulting GmbH address provided in clause 10 of this Privacy Policy, but please note that a request for data transfer can only be granted if it does not cause disproportionate expenditure or work.

If you believe that Hladky IT Consulting GmbH's processing of personal data is in violation of current data protection legislation or that data privacy rights have been violated in some other way, you can lodge a complaint with the relevant supervisory authority (data protection authority). In Austria, the competent data protection authority is called Datenschutzbehörde.

We erase your user data 24 months following the termination of your membership of the Hladky IT Consulting GmbH platform.

3. Data security

We take appropriate organisational and technical precautions to protect personal data. These precautions concern, in particular, protection against unauthorised, unlawful, or accidental access, processing, loss, use, and tampering.

Although we make every effort to maintain appropriately high standards of diligence at all times, we cannot provide a complete warranty that the information we receive from you over the internet cannot be viewed or used by others.

Hladky IT Consulting GmbH does not, therefore, accept any liability whatsoever for information being disclosed due to faulty data transmission and/or unauthorised access by third parties (e.g., hacker attacks on email accounts, servers, etc.), where disclosure is not the fault of Hladky IT Consulting GmbH.

4. Use of data

Any data you disclose to Hladky IT Consulting GmbH are only used for purposes covered by the agreement or by your consent as the user or by some other purpose specified in the provisions of GDPR. The only exception is the use of data for statistical purposes, in which case the data you disclose are used in anonymised form.

5. Transmission of data to third parties

Performance of the agreement may require us to disclose your user data to third parties (e.g., contractors engaged by Hladky IT Consulting GmbH). Your data are passed on entirely on the basis of GDPR, notably in order to meet your request or on the basis of your prior consent.

Some of the aforementioned recipients of personal data are either located outside your place of residence or they are processed there. The level of data protection in other countries may not always be the same as in Austria. However, Hladky IT Consulting GmbH only sends your personal data to countries for which the EU Commission has decided that their level of data protection is adequate or, alternatively, Hladky IT Consulting GmbH takes precautions to ensure that all data recipients have an adequate level of data protection, for which purpose Hladky IT Consulting GmbH concludes standard contractual clauses (2010/87/EC and/or 2004/915/EC).

If there is a statutory obligation or if we have received a regulatory instruction or court order, we are compelled to disclose your data to the relevant public authorities or court of law.

Hladky IT Consulting GmbH will make every effort to ensure that data breaches are identified at an early stage and, where necessary, will report them immediately to you as the user and/or to the competent supervisory authority specifying the data categories which have been affected.

7. Data storage

Hladky IT Consulting GmbH does not store data any longer than required in order to meet its contractual and/or statutory obligations or to defend against possible liability claims.

10. Marketing emails with Mailchimp

We utilize Mailchimp, an email marketing service, to manage and deliver our email communications, newsletters, and promotional messages. When you subscribe to our email list, your email address and name are collected and processed by Mailchimp on our behalf. We assure you that we are committed to safeguarding your data privacy and adhere to all applicable data protection laws. Mailchimp is GDPR-compliant and takes the necessary steps to protect the confidentiality and security of your personal data. 11. ClickUp CRM

By contacting us via the contact form at push-based.io/contact, your name, email, and company URL, as well as your IP address, will be collected and processed with ClickUp. ClickUp is a CRM and task-tracking tool that we use to save and work with customer data to fulfill contracts and plan communications. ClickUp is fully GDPR compliant and fulfills all applicable data protection laws. GDPR compliant usage tracking with Matomo

1 – About Matomo

Matomo is an open source web analytics platform. We use Matomo in order to measure, collect, analyze and report visitor data for purposes of understanding and optimizing their website.

2 – Purpose of the processing

Matomo is used to analyze the behavior of the website visitors to identify potential pitfalls; not found pages, search engine indexing issues, which contents are the most appreciated and which marketing activities perform best. Once the data is processed, Matomo generates reports for website owners to take action, for example changing the layout of the pages, publishing some fresh content… etc.

Matomo is processing the following personal data:

  • Anonymized IP address

  • Anonymized Referrer Data

  • Custom Dimensions

  • Custom Variables

  • Location of the user

And also:

  • Date and time

  • Title of the page being viewed

  • URL of the page being viewed

  • URL of the page that was viewed prior to the current page

  • Screen resolution

  • Time in local timezone

  • Files that were clicked and downloaded

  • Link clicks to an outside domain

  • Pages generation time

  • Country, region, city

  • Main Language of the browser

  • User Agent of the browser

The processing of personal data with Matomo is based on legitimate interests.

3 – The legitimate interests

Processing your personal data such as cookies is helping us identify what is working and what is not on our website. For example, it helps us identify if the way we are communicating is engaging or not and how we can organize the structure of the website better. Our team is benefiting from the processing of your personal data, and they are directly acting on the website. We are keeping the anonymized usage data captured within Matomo for no longer than necessary to fulfill the processing purposes.

As Matomo is processing personal data on legitimate interests, you can exercise the following rights:

  • Right to erasure: you can ask us at any time to delete all the personal data we are processing about you.

8 – The right to lodge a complaint with a supervisory authority

If you think that the way we process your personal data with Matomo analytics is infringing the law, you have the right to lodge a complaint with a supervisory authority.

9 – Whether the provision of personal data is part of a statutory or contractual requirement; or obligation and possible consequences of failing to provide the personal data

If you wish us to not process any personal data with Matomo, you can opt-out from it at any time. There will be no consequences at all regarding the use of our website.

Matomo is not doing any profiling.
